CQR does not count controlled substances against the provider. Those are tossed out of the denominator.
However, not doing an erx on a state controlled substance does count against us. We're finding meds like Neurontin, Gabapentin, Tramadol, are not omitted from the MIPS/CQR counts, but we are not permitted by state law to eprescribe these. Even if we try, they always fail. We're being penalized in MIPS because of this, and for some providers it's a pretty big portion (50%)!
This is in West Virginia. Are providers in other states having this problem, where the state law is less forgiving than the federal law? Have you found any workarounds?
